BT-75 Guarantee Required Description - clarification
We want to clarify the description of BT-75:
The description of the financial guarantee required from the tenderer when submitting a tender. The guarantee can take the form of, for example, a payment to the buyer or a document from a bank. Typically, the guarantee would be forfeit when a tenderer has won the contract but then refused to sign it.
Especially the last sentence of BT-75 is contradicting German law and needs to be clarified, before we tailor it out:
Typically, the guarantee would be forfeit when a tenderer has won the contract but then refused to sign it.
In Germany a tenderer has no opportunity to sign a contract and therefore cannot refuse it.
