BT-717 - "scope" of CVD

BT-717 (Clean Vehicles Directive) has the following description: "The procurement falls within the scope of Directive 2009/33/EC of the European Parliament and of the Council (Clean Vehicles Directive – CVD)." [small note: the excel file for the 3rd amendment misquotes the description]

The scope of the Directive is however partially determined by the Member States, as these may choose to (not) exclude vehicles referred to in Art. 2 of the CVD Directive 2009/33/EC.

Therefore, the description could be read as potentially covering the widest possible scope even where a Member State has made use of the exemptions. This would however not be helpful for the aim of the CVD fields, which is to provide statistical data to the Member States and the Commission on the national fulfilment of the relevant quotas for clean vehicle purchases. Whether a category of vehicles is exempt according to Art. 2 is something the Commission would already know from the notification of the transposed laws, eForms are therefore not needed for this purpose.

To clarify, the following (or something like it) could be added to the description:"The procurement falls within the scope of Directive 2009/33/EC of the European Parliament and of the Council (Clean Vehicles Directive – CVD), excluding national exemptions according to Art. 2 of that Directive.".

This would hopefully also help with the understanding of BT-723, BT-715, BT-725 and BT-716, which also refer to the scope of the Directive.
