BR-BT-00109-0054 : Currently "Duration: UNLIMITED" is considered 'less than 4 years'

Rule "BR-BT-00109-0054" et. al. states that for a framework agreement with a duration longer than 4 years (and an other number for similar rules) there MUST be a justfication (BT-109-Lot)), and there MUST NOT be a justification if the duration is less.

But the duration can not only be defined by definite dates via BT-536-Lot/BT-537-Lot or the explizit duration via BT-36, but also by other means of BT-538-Lot, which include the options "UNKNOWN" and "UNLIMITED".

Currently the rule forbid the justification, if one of the other options "UNKNOWN" und even "UNLIMITED" is selected.

  • For the option "UNKNOWN" a justification should be optional -- perhaps the exact duration is not know, but estimated to be longer than 4 year (perhaps the termination depends on some uncontrolled condition).
  • For the option "UNLIMMITED" a justification should be allowed and mandatory -- usually this means a much longer time than foru years, and perhaps the decision for an unlimited time itself should be justified.
