BT-726 and BT-115 application to design contests?

BT-726 "Suitable for SMEs" is not available for design contest CN - however, design contests, in particular when it comes to innovation, may be highly relevant to SMEs. It would make sense to make this field available as optional.

BT-115 "GPA Coverage" is not available for design contest CN. However, design contests are addressed in Art. 13(h) of the GPA agreement - this is mirrored in the provision on the negotiated procedure without prior publication in, for example, Art. 32 (4) of Directive 2014/24/EU. The mentioned GPA provision also requires that "the contest has been organized in a manner that is consistent with the principles of this Agreement, in particular relating to the publication of a notice of intended procurement". The latter part is again mirrored in BT-41 "following contract" ("Any service contract following the contest will be awarded to one of the winners of the contest."). If such a design contest were not covered by the GPA, then the GPA could easily be circumvented for the works/services where there is coverage (e.g. architectural services) by first doing a design contest. Therefore, the field BT-115 should be available here as an optional field as GPA coverage exists here.
