reporting a contract outside the scope of the Directives (BT-01; BT-105, BT-136)

I would appreciate a clarification about reporting a contract outside the scope of the Directives. Which approach is advisable and “the proper” one:

  1. To choose for example “Directive 2014/24/EU” in BT-01 “Procedure Legal Basis”, to choose “Negotiated without prior call for competition” in BT-105 “Procedure Type “and to choose an appropriate value in the codelist BT-136 “Direct Award Justification Code”;

  2. To choose “Other” in BT-01 “Procedure Legal Basis”, to choose “Negotiated without prior call for competition” in BT-105 “Procedure Type“ and to choose an appropriate value in the codelist BT-136 “Direct Award Justification Code” (for example “in-house”); We saw in Developer Docs that “…The Procedure Legal Basis term refers to the EU regulatory domain that applies to the procurement. ... The "other" value shall exclusively be used for below threshold notices”. Is it possible to use this field also for out-of-Directives contracts?

  3. To choose for example “Directive 2014/24/EU” in BT-01 “Procedure Legal Basis”, to choose “Other single stage procedure” in BT-105 “Procedure Type “.

Do you recommend any other option? Our question is connected to the future statistics of contract exceptions – we would like to be sure that we have a common understanding on national and on EU level.
