Code list on Exclusion Grounds added and open for comments

The code list on Exclusion Grounds is available and open for comments. It is the code list behind BT-67(a). Please use this issue for comments. As we need to implement in eForms in SDK 1.12 Exclusion Grounds and Selection Criteria, we will use the list linked below. Nevertheless, we would like to get comments from all to improve the list for SDK 1.13. Some important points for this code list:

  • This code list is a taxonomy, meaning that it has two levels. The group of a number of Exclusion Grounds and the the actual ground. An example is below. You will see that the group in the example is exg-crim and the grounds will then start with this code like exg-crim-corr.
  • For eForms, currently only the actual grounds will be used, not the groups.
  • Through using the codes, we also group logical exclusion grounds together. An example is about breaching of environmental, social and labour law. The three codes are exg-mis-bre-env-law, exg-mis-bre-lab-law and exg-mis-bre-soc-law. This will make it easier to read through the list and also will help in user interfaces to see corresponding grounds next to each other.
  • Two new Exclusion Grounds were added due to the Defence Directive. They have the codes exg-mis-off-cond and exg-mis-unrel-sec.
  • We created a new group exg-sitn - Grounds relating to the situation of the economic operator, where we put the grounds on brankruptcy, insolvency etc.
  • Some of the labels and almost all definitions were updated to improve readability. In a future update for eCertis, we will reuse this code list to align it fully. This will also have in the future an impact on the ESPD.
  • One last point, this might be also a good chance for the subgroup from EXPP who works on Exclusion Grounds to see how we can add other grounds from sectorial legislation.
Code Label Definition
exg-crim Grounds relating to criminal convictions Exclusion grounds that are related to criminal convictions.
exg-crim-corr Corruption The economic operator itself or any person who is a member of its administrative, management or supervisory body or powers of representation, decision or control therein has been the subject of a conviction by final judgement for corruption, by a conviction rendered at the most five years ago or in which an exclusion period set out directly in the conviction continues to be applicable. Corruption, as defined in the relevant legislation.

The aim is to have, if necessary, an improved list until mid-August, so that we can include the list in SDK 1.13. Looking forward to receive your comments!
